1. Chi siamo e cosa regolano questi Termini

Chitarrrino è un servizio di Mentoring S.r.l., Via Tofane 27, 10141 Torino (TO), Italia, P. IVA IT11233150017 («noi»). Questi Termini regolano l'uso dell'app Chitarrrino e dei servizi collegati. Ne fanno parte anche le Regole della community e, per quanto riguarda i dati personali, l'Informativa sulla privacy.

Creando un account e toccando «Accetto» dichiari di aver letto e di accettare questi Termini. Se non li accetti, non puoi usare Chitarrrino.

2. Il servizio

Chitarrrino ti aiuta a conoscere altri cani e i loro padroni vicino a te e a organizzare passeggiate e giochi in luoghi pubblici. Il cane è sempre al centro: sfogli i profili dei cani, metti Zampa a quelli che ti piacciono e, se la Zampa è reciproca, nasce un match con cui chattare e proporre una passeggiata. La sezione In Coppia permette, a chi ha verificato il documento, di conoscere anche i padroni.

Il servizio di base è gratuito. Alcune funzioni sono comprese nell'abbonamento facoltativo Chitarrrino Oro (paragrafo 9). Possiamo migliorare, cambiare o togliere funzioni; se una modifica riduce in modo rilevante ciò che hai acquistato, te lo diciamo prima e puoi recedere.

3. Chi può usare Chitarrrino

Per usare Chitarrrino devi:

• avere almeno 18 anni;
• essere una persona fisica e usare un solo account;
• non essere stato espulso da Chitarrrino in passato, salvo nostra autorizzazione;
• non aver riportato condanne per reati sessuali, reati violenti contro la persona o maltrattamento di animali, e non essere sottoposto a misure che ti vietano di usare un servizio come questo;
• essere il proprietario del cane del profilo, o una persona che se ne prende cura con il consenso del proprietario;
• rispettare le leggi applicabili.

4. Il tuo account

Le informazioni che inserisci devono essere vere e aggiornate: foto recenti tue e del tuo cane, niente foto di altre persone. Sei responsabile di ciò che accade con il tuo account: proteggi l'accesso al tuo telefono e alla tua email e avvisaci subito a [email protected] se sospetti un uso non autorizzato. Possiamo chiederti di ripetere la verifica, per esempio se cambi le foto o se riceviamo segnalazioni.

5. Verifica dell'identità

Alcune funzioni richiedono una verifica, svolta dal nostro fornitore Didit:

• Face Check (video-selfie): per mettere Zampa, mandare Ossi e chattare. In alternativa puoi chiedere la verifica manuale;
• documento d'identità: per In Coppia e per proporre o accettare una passeggiata.

Come trattiamo questi dati è spiegato nell'Informativa sulla privacy: in breve, non conserviamo né il video né il documento, ma solo l'esito. I badge indicano che una persona ha superato i controlli previsti; non garantiscono chi sia davvero né come si comporterà. Usa sempre prudenza (paragrafo 8).

6. Regole di comportamento: tolleranza zero

Devi rispettare le Regole della community. Su Chitarrrino c'è tolleranza zero per i contenuti inaccettabili (nudità, contenuti sessuali, violenza, crudeltà verso gli animali, odio, molestie, minacce, truffe, spam) e per gli utenti che abusano degli altri. Non puoi inoltre:

• usare Chitarrrino per scopi commerciali, compresa la vendita di animali, le monte a pagamento, la pubblicità o la raccolta di contatti;
• offrire o chiedere denaro, regali o incontri a pagamento;
• fingerti un'altra persona o usare foto che non ti appartengono;
• accedere al servizio con sistemi automatici, copiarne i contenuti o aggirarne i limiti e le verifiche;
• chiedere ad altri utenti di spostarsi su altri canali per aggirare le protezioni della chat.

Esaminiamo le segnalazioni entro 24 ore e, se una regola è stata violata, possiamo rimuovere i contenuti, limitare le funzioni, sospendere o chiudere l'account e, nei casi previsti dalla legge, informare le autorità.

7. I tuoi contenuti

Le foto, i testi e i messaggi che pubblichi («contenuti») restano tuoi. Per far funzionare il servizio ci concedi una licenza non esclusiva, gratuita e valida in tutto il mondo per conservarli, riprodurli, adattarli (per esempio ridimensionare le foto) e mostrarli agli altri utenti all'interno di Chitarrrino, per il tempo in cui restano pubblicati e per il periodo tecnico necessario a cancellarli dai backup. Non usiamo le foto tue o del tuo cane nella nostra pubblicità senza il tuo permesso esplicito.

Garantisci di avere i diritti sui contenuti che pubblichi e il consenso delle persone ritratte. Non pubblicare foto di minori. I contenuti passano da controlli automatici e, quando serve, da una revisione umana; possiamo rifiutare o rimuovere quelli che violano questi Termini o la legge.

8. Incontri e passeggiate

Gli incontri avvengono sotto la tua responsabilità. Ti chiediamo di:

• incontrarti la prima volta in un'area cani pubblica, di giorno, e avvisare qualcuno di fiducia (puoi usare «Condividi la passeggiata»);
• portare il cane al guinzaglio nei primi minuti e rispettare le regole locali su guinzaglio, museruola e raccolta delle deiezioni;
• portare solo cani in buona salute, vaccinati e identificati con microchip come prevede la legge, e non portare cani aggressivi o femmine in calore a incontri di gioco;
• fermarti se un cane non è a suo agio: prima il cane.

Sei responsabile del tuo cane e dei danni che può causare a persone, animali o cose (in Italia art. 2052 del Codice civile; in Spagna art. 1905 del Código Civil). Non verifichiamo il carattere né lo stato di salute dei cani e non partecipiamo agli incontri. In caso di emergenza chiama il 112. Segnalaci qualsiasi comportamento scorretto, anche avvenuto fuori dall'app.

9. Chitarrrino Oro e acquisti

Chitarrrino Oro è un abbonamento con rinnovo automatico, mensile o annuale, che si acquista solo tramite l'App Store di Apple o Google Play. Prima dell'acquisto l'app mostra le funzioni incluse, la durata e il prezzo, preso dallo store nella tua valuta.

• Il pagamento viene addebitato sull'account Apple o Google alla conferma dell'acquisto.
• L'abbonamento si rinnova automaticamente alla fine di ogni periodo, allo stesso prezzo, salvo che tu lo disdica almeno 24 ore prima della scadenza; il rinnovo viene addebitato nelle 24 ore precedenti.
• Puoi gestire o disdire l'abbonamento dalle impostazioni del tuo account Apple o Google. Eliminare l'account Chitarrrino o disinstallare l'app non disdice l'abbonamento.
• Se il prezzo cambia, lo store ti avvisa secondo le sue regole e puoi disdire prima che il nuovo prezzo si applichi.
• I rimborsi sono gestiti da Apple o da Google secondo le loro procedure. Se sei un consumatore restano fermi i diritti previsti dalla legge, compreso, dove applicabile, il diritto di recesso entro 14 giorni, che si esercita tramite lo store.
• Ossi, Boost e le altre funzioni incluse non hanno valore in denaro, non si possono cedere e non si convertono in denaro.

Se chiudiamo l'account per una violazione grave di questi Termini, nei limiti consentiti dalla legge non rimborsiamo il periodo di abbonamento residuo.

10. Proprietà intellettuale

L'app, il nome e il marchio Chitarrrino, la mascotte Chitarrino, i testi, la grafica, il jingle e il software appartengono a Mentoring S.r.l. o ai suoi licenzianti. Ti concediamo una licenza personale, non esclusiva e non cedibile per usare l'app secondo questi Termini. Non puoi copiare, modificare, decompilare (salvo nei casi consentiti dalla legge) o sfruttare commercialmente il servizio.

11. Sospensione e chiusura dell'account

Puoi eliminare l'account quando vuoi da Profilo › Impostazioni › Elimina account, o seguendo le istruzioni su chitarrrino.com/delete-account.

Possiamo sospendere o chiudere un account, anche senza preavviso quando serve a proteggere altre persone, se viola questi Termini o le Regole della community, se lo impone la legge o un'autorità, o se crea rischi per gli altri utenti. Possiamo chiudere gli account inattivi da oltre 24 mesi, con un preavviso di 30 giorni via email. Quando limitiamo un contenuto o un account ti spieghiamo il motivo e su quali regole ci basiamo; puoi chiedere il riesame della decisione rispondendo alla nostra comunicazione o scrivendo a [email protected] entro 6 mesi: la decisione sarà riesaminata da una persona diversa da quella che l'ha presa.

12. Segnalazioni e punti di contatto (Regolamento sui servizi digitali)

Puoi segnalare contenuti illegali o contrari alle regole direttamente dall'app (Segnala, su ogni profilo e in chat) o scrivendo a [email protected], indicando il contenuto e il motivo. Il punto di contatto per gli utenti e per le autorità degli Stati membri, della Commissione europea e del Comitato europeo per i servizi digitali è [email protected] (in italiano, inglese o spagnolo).

13. Responsabilità

Mettiamo impegno nel mantenere Chitarrrino sicuro e disponibile, ma il servizio può avere interruzioni o errori. Non rispondiamo del comportamento degli altri utenti, dentro o fuori dall'app, né dei danni causati dai loro cani. Nei limiti consentiti dalla legge non siamo responsabili dei danni indiretti. Nulla in questi Termini limita la nostra responsabilità per dolo o colpa grave, per danni alla persona o nei casi in cui la legge non consente di escluderla, né i diritti che ti spettano come consumatore.

14. Modifiche ai Termini

Possiamo aggiornare questi Termini, per esempio per nuove funzioni o per cambiamenti di legge. Ti avvisiamo nell'app almeno 15 giorni prima che le modifiche rilevanti abbiano effetto, salvo quelle urgenti per motivi di legge o di sicurezza. Se non le accetti puoi eliminare l'account prima che si applichino.

15. Legge applicabile e controversie

Questi Termini sono regolati dalla legge italiana. Se sei un consumatore conservi le tutele inderogabili della legge del Paese in cui risiedi e, per qualsiasi controversia, è competente il giudice del luogo della tua residenza o del tuo domicilio. Negli altri casi è competente in via esclusiva il Foro di Torino. Prima di rivolgerti al giudice puoi scriverci a [email protected]: cerchiamo sempre una soluzione amichevole.

16. Se hai scaricato l'app dall'App Store o da Google Play

Per l'app scaricata dall'App Store la licenza d'uso è regolata anche dal contratto di licenza standard di Apple per l'utente finale (Licensed Application End User License Agreement: www.apple.com/legal/internet-services/itunes/dev/stdeula/); in caso di contrasto sulla licenza d'uso dell'app, prevale quest'ultimo. Apple e Google non sono responsabili del servizio né dell'assistenza, che fornisce Mentoring S.r.l. Per l'app scaricata da Google Play si applicano anche i Termini di servizio di Google Play.

Chitarrrino Terms of Service

This is a translation. If it differs from the Italian version, the Italian version prevails.

1. Who we are and what these Terms cover

Chitarrrino is a service of Mentoring S.r.l., Via Tofane 27, 10141 Turin (TO), Italy, VAT IT11233150017 ("we", "us"). These Terms govern the use of the Chitarrrino app and related services. The Community Guidelines are part of them and, for personal data, so is the Privacy Policy.

By creating an account and tapping "Accept" you confirm that you have read and accept these Terms. If you do not accept them, you may not use Chitarrrino.

2. The service

Chitarrrino helps you meet other dogs and their owners near you and organise walks and play in public places. The dog always comes first: you browse dog profiles, give a Paw to the ones you like and, if the Paw is mutual, you get a match you can chat with and propose a walk to. The Pairs (In Coppia) section lets people who have verified their ID also get to know the owners.

The basic service is free. Some features are included in the optional Chitarrrino Oro subscription (section 9). We may improve, change or remove features; if a change significantly reduces what you paid for, we will tell you in advance and you may cancel.

3. Who can use Chitarrrino

To use Chitarrrino you must:

• be at least 18 years old;
• be a natural person and use a single account;
• not have been banned from Chitarrrino before, unless we allow it;
• not have been convicted of sexual offences, violent offences against persons or animal cruelty, and not be subject to measures forbidding you from using a service like this;
• own the dog in your profile, or care for it with the owner's consent;
• comply with applicable laws.

4. Your account

The information you enter must be true and up to date: recent photos of you and your dog, no photos of other people. You are responsible for what happens with your account: protect access to your phone and email and let us know at [email protected] straight away if you suspect unauthorised use. We may ask you to verify again, for example if you change your photos or if we receive reports.

5. Identity verification

Some features require verification, performed by our provider Didit:

• Face Check (video selfie): to give Paws, send Bones and chat. Alternatively you can ask for manual verification;
• ID document: for Pairs and to propose or accept a walk.

How we process this data is explained in the Privacy Policy: in short, we keep neither the video nor the document, only the result. Badges show that a person has passed the checks; they do not guarantee who someone really is or how they will behave. Always be careful (section 8).

6. Rules of conduct: zero tolerance

You must follow the Community Guidelines. Chitarrrino has zero tolerance for objectionable content (nudity, sexual content, violence, cruelty to animals, hate, harassment, threats, scams, spam) and for users who abuse others. You also may not:

• use Chitarrrino for commercial purposes, including selling animals, paid stud services, advertising or collecting contacts;
• offer or ask for money, gifts or paid meetings;
• impersonate someone else or use photos that are not yours;
• access the service with automated systems, copy its content or circumvent its limits and checks;
• ask other users to move to other channels to get around the chat's protections.

We review reports within 24 hours and, if a rule has been broken, we may remove content, limit features, suspend or close the account and, where the law requires, inform the authorities.

7. Your content

The photos, texts and messages you post ("content") remain yours. To run the service you grant us a non-exclusive, free, worldwide licence to store, reproduce, adapt (for example resize photos) and show them to other users within Chitarrrino, for as long as they remain posted and for the technical time needed to erase them from backups. We do not use photos of you or your dog in our advertising without your explicit permission.

You confirm that you hold the rights to the content you post and the consent of the people shown. Do not post photos of minors. Content goes through automated checks and, where needed, human review; we may reject or remove content that breaks these Terms or the law.

8. Meetings and walks

Meetings take place under your own responsibility. We ask you to:

• meet for the first time in a public dog park, in daylight, and tell someone you trust (you can use "Share the walk");
• keep your dog on the lead for the first few minutes and follow local rules on leads, muzzles and picking up after your dog;
• bring only dogs that are healthy, vaccinated and microchipped as required by law, and not bring aggressive dogs or females in heat to play meetings;
• stop if a dog is not comfortable: dog first.

You are responsible for your dog and for any damage it causes to people, animals or property (in Italy Art. 2052 of the Civil Code; in Spain Art. 1905 of the Código Civil). We do not check dogs' temperament or health and we do not take part in meetings. In an emergency call 112. Report any misconduct to us, even if it happened outside the app.

9. Chitarrrino Oro and purchases

Chitarrrino Oro is an auto-renewing monthly or yearly subscription, sold only through Apple's App Store or Google Play. Before you buy, the app shows the features included, the duration and the price, taken from the store in your currency.

• Payment is charged to your Apple or Google account when you confirm the purchase.
• The subscription renews automatically at the end of each period at the same price unless you cancel it at least 24 hours before it ends; the renewal is charged within the 24 hours before.
• You can manage or cancel the subscription in your Apple or Google account settings. Deleting your Chitarrrino account or uninstalling the app does not cancel the subscription.
• If the price changes, the store notifies you under its rules and you can cancel before the new price applies.
• Refunds are handled by Apple or Google under their own procedures. If you are a consumer, your statutory rights are not affected, including, where applicable, the 14-day right of withdrawal, which you exercise through the store.
• Bones, Boosts and other included features have no cash value, cannot be transferred and cannot be exchanged for money.

If we close your account for a serious breach of these Terms, to the extent permitted by law we do not refund the remaining subscription period.

10. Intellectual property

The app, the Chitarrrino name and trademark, the mascot Chitarrino, texts, graphics, jingle and software belong to Mentoring S.r.l. or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the app under these Terms. You may not copy, modify, decompile (except where the law allows) or commercially exploit the service.

11. Suspension and closure

You can delete your account at any time in Profile › Settings › Delete account, or by following the instructions at chitarrrino.com/delete-account.

We may suspend or close an account, without notice where needed to protect others, if it breaks these Terms or the Community Guidelines, if the law or an authority requires it, or if it puts other users at risk. We may close accounts inactive for more than 24 months, with 30 days' notice by email. When we restrict content or an account we tell you why and which rules we rely on; you can ask for the decision to be reviewed by replying to our message or writing to [email protected] within 6 months: the decision will be reviewed by a different person from the one who made it.

12. Notices and points of contact (Digital Services Act)

You can report illegal content or content against the rules directly in the app (Report, on every profile and in chat) or by writing to [email protected], stating the content and the reason. The point of contact for users and for the authorities of the Member States, the European Commission and the European Board for Digital Services is [email protected] (in Italian, English or Spanish).

13. Liability

We work to keep Chitarrrino safe and available, but the service may have interruptions or errors. We are not responsible for the behaviour of other users, inside or outside the app, or for damage caused by their dogs. To the extent permitted by law we are not liable for indirect damages. Nothing in these Terms limits our liability for wilful misconduct or gross negligence, for personal injury or where the law does not allow it to be excluded, nor your rights as a consumer.

14. Changes to the Terms

We may update these Terms, for example for new features or changes in the law. We will notify you in the app at least 15 days before significant changes take effect, except urgent changes for legal or safety reasons. If you do not accept them you can delete your account before they apply.

15. Governing law and disputes

These Terms are governed by Italian law. If you are a consumer you keep the mandatory protections of the law of your country of residence and any dispute falls under the court of the place where you live or are domiciled. In all other cases the courts of Turin have exclusive jurisdiction. Before going to court you can write to [email protected]: we always look for an amicable solution.

16. If you downloaded the app from the App Store or Google Play

For the app downloaded from the App Store, the licence to use it is also governed by Apple's standard Licensed Application End User License Agreement (www.apple.com/legal/internet-services/itunes/dev/stdeula/); in case of conflict regarding the app licence, the latter prevails. Apple and Google are not responsible for the service or for support, which Mentoring S.r.l. provides. For the app downloaded from Google Play, the Google Play Terms of Service also apply.
